☐ The customer warrants that they own or have obtained all necessary rights, licences and permissions to submit the music, images, artwork, lyrics, photographs and promotional materials supplied to The FizikalReck Sessions.

☐ I understand that The FizikalReck Sessions provides independent editorial reviews, interviews and artist features based on the selected package.

☐ I acknowledge that all reviews, opinions and commentary published by The FizikalReck Sessions are independent and represent the genuine views of the reviewer.

☐ I understand that payment is for the time involved in listening to, assessing, reviewing, writing, editing, publishing and promoting the submitted material and does not guarantee a favourable review, rating, recommendation or outcome.

☐ I understand that once work has commenced, fees are non-refundable due to the time and editorial services provided.

☐ For the purposes of this policy, work is deemed to have commenced when The FizikalReck Sessions begins reviewing, assessing, listening to, researching, preparing, writing, editing or otherwise allocating resources to the customer's submission.

☐ I grant The FizikalReck Sessions permission to use supplied artist biographies, promotional images, album artwork, press materials and approved music excerpts for the purpose of publishing reviews, interviews, artist features and related promotional content.

☐ Published reviews, interviews, artist features and associated editorial content remain the intellectual property of The FizikalReck Sessions unless otherwise agreed in writing.

☐ I understand that publication timeframes are estimates only and may vary depending on submission volumes and editorial schedules.

☐ I acknowledge that submission does not guarantee publication if the supplied materials are incomplete, inaccurate, offensive, defamatory, unlawful or infringe the rights of any third party.

☐ I have read and agree to the Terms and Conditions and Privacy Policy of The FizikalReck Sessions.

Limitation of Liability

To the maximum extent permitted by law, The FizikalReck Sessions and Fargun Bewdy Pty Ltd shall not be liable for any indirect, consequential, incidental or economic loss arising from the use of our services, including but not limited to loss of income, loss of opportunity, loss of reputation, loss of audience growth or loss of future business opportunities.

The FizikalReck Sessions and FizikalReck are promotional and editorial brands administered by Fargun Bewdy Pty Ltd. Cancellation Before Work Commences

Where no work has commenced, a refund may be provided at the discretion of The FizikalReck Sessions, less any payment processing fees, administrative costs or non-recoverable charges incurred.

Once Work Has Commenced

By placing an order, the customer acknowledges and agrees that:

  • Work may commence shortly after payment and receipt of the required submission materials.

  • Once work has commenced, fees are generally non-refundable because resources, time and editorial services have already been allocated to the project.

This does not affect any rights available under the Australian Consumer Law.

Customer Agreement

Failure to Provide Required Information

If the customer fails to provide the information, materials or responses reasonably required to complete the purchased service within 90 days of purchase, The FizikalReck Sessions may close the order and consider the service abandoned. Any refund request will be assessed having regard to the work already completed and the requirements of the Australian Consumer Law.

Extensions may be granted at our discretion.

Defamation Protection

Customers agree not to submit material that is unlawful, defamatory, misleading, fraudulent, offensive or infringes the rights of any third party. The FizikalReck Sessions reserves the right to reject any submission that may expose the business to legal, reputational or regulatory risk.
